    Personal injury cases usually involve some sort of accident. Car, truck, bicycle, and pedestrian accidents are all common matters for the civil courts to handle. This means that it is more likely than not that the other party was responsible for your injuries due to their negligent actions. The four elements required to prove this are that the other person owed you a duty of care, that they acted in some way that breached that duty, that the breach was the cause of your injuries, and that you sustained damages of some sort.

    While it is possible for a personal injury case to go to trial, most of them are settled out of court, whether that’s in a pretrial settlement or through some form of alternative dispute resolution, such as mediation. Negotiating a fair settlement requires understanding what compensation you’re entitled to and balancing this with the time, stress, and uncertainty of a trial.

    The basic process of a trial involves both parties having the opportunity to present evidence, witness testimony, and legal arguments to prove their case. As the plaintiff, your role is to convince a jury that it is more likely than not that the other party acted in a way that caused the accident and that the accident caused your injuries.
